The Administrative False Claims Act (AFCA), passed in December 2024, strengthens the government’s ability to enforce cybersecurity obligations by allowing agencies to pursue claims independently of DOJ involvement. The damage cap was doubled and allows agencies like the DoD more power to address smaller cybersecurity violations and refer serious cases to the DOJ. The DOJ secured about $3 billion under the False Claims Act.
